1. Scope
PROBIOSA – Michael Budi (hereinafter “PROBIOSA”) sells and delivers all goods exclusively on the basis of the following terms and conditions of sale and delivery. These terms also apply to all future business relationships, even if they are not expressly agreed upon again. By placing an order, these conditions are deemed accepted. Deviating terms of the customer are not recognized.
2. Prices
a) Consumer prices for deliveries within Germany and the rest of the EU include the applicable value-added tax (VAT). In the event of a change in the VAT rate during the validity period of an offer, we reserve the right to provide an adjusted offer accordingly.
For deliveries to non-EU countries, the gross price shown in the shop is considered the net price. You will receive an invoice without VAT shown.
b) All prices are stated in euros (€).
c) Prices are subject to change and errors excepted.
3. Payment and Default
a) Payment methods:
- Prepayment with 2% discount
- Net via PayPal
- Net by invoice (subject to sufficient creditworthiness)
- Cash on collection with 2% discount
b) Regardless of a reminder, the customer is considered in default at the latest if payment is not made within 8 days after the due date and receipt of the invoice. In case of default, the following reminder structure applies:
- 1st reminder: after 14 days from invoice date, no reminder fee (for online contracts, sent by email)
- 2nd and final reminder: after 28 days from invoice date, €5 reminder fee
c) If the full invoice amount is not paid within 40 days from the invoice date, a debt collection procedure will be initiated with all legal consequences. All resulting costs shall be borne by the debtor.
d) When ordering by invoice, you agree to a credit check before contract confirmation. If you do not agree, please choose another payment method.
4. Shipping, Delivery and Returns
For orders with a gross value of €69 or more, standard shipping within Germany is free of charge. Below this amount, shipping costs are calculated individually based on weight and package size.
Shipping costs for international deliveries are calculated individually based on destination and weight. For shipments over 30 kg, please contact the seller before payment. The buyer bears the shipping risk.
For pallet deliveries (freight forwarding), the actual transport costs incurred will be charged.
For prepayment orders, the stated delivery time begins upon receipt of payment in our account.
We are entitled to make partial deliveries.
In the event of a return, the buyer bears the regular return shipping costs.
5. Packaging Material
Packaging materials are not charged separately. We strive to make our packaging as environmentally friendly as possible through direct recycling and the use of eco-friendly materials.
We have concluded a licensed disposal contract for all packaging placed on the market in accordance with legal requirements.
We are registered with the Central Agency Packaging Register Foundation (www.verpackungsregister.org) under LUCID DE3991709314627.
6. Right of Withdrawal
As a consumer, you have the right to withdraw from a distance contract within 14 days without giving any reason.

7. Warranty and Complaints
Statutory provisions under the German Civil Code (BGB) apply to warranty, guarantee, and customer service.
Legitimate special offers are excluded from exchange or return.

If one or more provisions of these terms are or become invalid, the validity of the remaining provisions shall remain unaffected. Deviating conditions must be agreed in writing. Verbal agreements are not valid.
